By processing your order and accepting these terms and conditions you acknowledge that you are over the age of eighteen (18) years. Upon delivery you will be required to provide proof of age.

Should Hungerford Hill Operations Pty Ltd suffer any damage or other losses as a result of a transaction entered into by a minor, Hungerford Hill Operations Pty Ltd reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Hungerford Hill Operations Pty Ltd.

Placing Your Order

By placing an order, you make an offer to us to purchase the products you have selected based on these terms and conditions. Hungerford Hill Operations Pty Ltd reserve the right to refuse service, terminate an account, remove or edit content, or cancel an order at their sole discretion. If we cannot process or accept your order after payment is received we will contact you by email or telephone.

Payment Methods And Processing

Hungerford Hill Operations Pty Ltd currently accepts American Express, Visa and MasterCard only.

We will email a tax invoice to you with your order confirmation. Your tax invoice is your proof of purchase.

Hungerford Hill Operations Pty Ltd purchases include GST unless otherwise stated on a product listing.

Supply Of Your Products

Subject to these terms and conditions, we will supply to you the products indicated on your order confirmation.

Delivery Of Your Products

Delivery time takes up to 21 working days from the date your payment is received. The estimated delivery times are in business days (Monday through Friday) excluding public holidays.

Although every effort is made to ship your order according to the estimated delivery times provided, estimated shipping times may change due to changes in supply or circumstances beyond our control. If your product has not arrived after the estimated delivery time, please call our customer service team at 02 4998 7666.

Unless otherwise agreed by us, we will deliver your products to the address indicated on your order confirmation. If no-one is available to take delivery of your products, our carrier will leave a card with details of where you can pick-up your product. Where delivery is by our courier service and no-one is available to take delivery, they will leave a card requesting you to telephone them to arrange a suitable time and date for delivery.

We will use every reasonable effort to deliver your products to you within the estimated delivery time, however, we do not guarantee that we will deliver within this time frame.

Title and risk of loss to all products will pass to you on delivery.

 

Your Data – Use And Protection

By placing your order, you agree that we may store, process and use data collected from your order form for the purposes of processing your order. You may obtain a copy of the data held by us concerning you on request in writing. We reserve the right to charge an administration fee for processing such a request. If any data held by us concerning you is incorrect, we will correct it on your written request. Please refer to our Privacy Policy.

Credit Card Fraud

Hungerford Hill Operations Pty Ltd will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

General

You shall not assign any rights and obligations under these terms and conditions whether in whole or in part without the prior written consent of Hungerford Hill Operations Pty Ltd. Any unauthorized assignment shall be deemed null and void. If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provisions in question shall not be affected thereby.

Under the Trade Practices Act 1974 (“Act”), where implied conditions and warranties cannot be excluded, any liability in Hungerford Hill Operation Pty Ltd for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option Hungerford Hill Operations Pty Ltd, to the replacement of the product(s) or the re-supply of the same product(s); the payment of the cost of replacing the product(s) or of acquiring equivalent product(s).

Neither our failure nor your failure to enforce any term or condition constitutes a waiver of such term or condition. Such failure shall in no way affect the right to later enforce such term or condition.

Hungerford Hill Operations Pty Ltd reserves the right to change the terms and conditions of sale at any time.

No Hungerford Hill Operations Pty Ltd employee or agent has the authority to vary any of the terms and conditions governing any sale.

Force Majeure

Hungerford Hill Operations Pty Ltd shall not be liable for any delay in performing any of its obligations under these terms and conditions if such delay is caused by circumstances beyond the reasonable control of Hungerford Hill Operations Pty Ltd, and Hungerford Hill Operations Pty Ltd shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.

PART A - INTRODUCTION 

  1. Information on how to enter and Prize details form part of these terms and conditions. 
  2. By participating in the Competition, entrants accept and agree to be bound by these terms and conditions. For the avoidance of doubt, the terms and conditions include the Schedule above. 
  3. Entries must comply with these terms and conditions to be valid. 
  4. Where there is an inconsistency between the Schedule and Parts A to J of these terms and conditions, the schedule will prevail. 

PART B - PRIVACY 

  1. The Promoter will collect and use each entrant’s personal information for the purposes of: 
    1. conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) and for promotional purposes, public statements and advertisements in relation to the Competition; 
    2. providing information about the products and services offered by the Promoter and its related companies and its affiliated retailers; and 
    3. research to improve its products and services. 
  2. By entering the Competition, entrants consent to the use of their personal information as described in clause 5. 

PART C - WHO CAN ENTER THE COMPETITION 

  1. If the Schedule permits entrants to be under the age of 18 years, such entrants must seek permission from their parent or guardian to enter. If the winner of a Prize is under 18 years of age, the Prize will be awarded to the winner’s parent or legal guardian. 
  2. Directors and employees (and their immediate families) of the Promoter or its related companies or agencies and Participating Retailers are not eligible to enter. Immediate families means spouse, ex-spouse, child, step-child, parent, step-parent, legal guardian, sibling or step-sibling. 

PART D – HOW TO ENTER THE COMPETITION 

  1. To enter, each entrant must comply with the ‘How to Enter’ section of the Schedule. 
  2. If the Schedule permits entrants to submit more than one entry, each entry must be unique and submitted separately. 
  3. Entries must not have been published previously or used to win prizes in other competitions. 
  4. An entry cannot be modified after it has been submitted. 
  5. The Promoter reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the Competition of all entrants. 
  6. The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter. 
  7. The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these terms and conditions or which contravene any applicable laws or regulations. 
  8. The Promoter reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these terms and conditions, has engaged in unlawful or improper conduct or otherwise acts to cheat or undermine the fairness of the Competition by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants. 
  9. The eligibility of entries is solely within the discretion of the Promoter. 
  10. The Promoter accepts no responsibility for late, lost, misdirected or damaged entries or other communications. 

PART E - PRIZES 

  1. Each Prize is not transferable, exchangeable or redeemable for cash. 
  2. If a Prize is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Prize with a prize of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority. 
  3. Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for the Prize being damaged, lost or stolen. 
  4. All taxes (excluding GST, if any) which may be payable as a consequence of receiving a Prize are the sole responsibility of each winner. 
  5. A winner's use of the Prize is entirely at their own risk. Before a Prize is awarded, a winner may be required to sign an agreement to release the Promoter from and indemnifying the Promoter against any liability arising from the winner’s acceptance and use of the Prize and the winner’s participation in the Competition. 

PART F - HOW THE WINNER(S) ARE DETERMINED 

  1. The Competition is a game of Chance. 
  2. At the time and date specified in the “Determining the winner(s)” section of the Schedule, each valid entry will be entered into a process of random selection. 
  3. The winning entry or entries will be the entry or entries that are selected at a random draw. 
  4. The number of winning entries to be selected will be the same as the total number of Prizes specified in the Schedule 
  5. The promoter’s decision will be final and binding and no correspondence with entrants or any other person will be entered into. 
  6. Each winner will receive a Prize. 

PART G - NOTIFICATION AND CLAIMING THE PRIZE(S) 

  1. The Promoter will provide each winner with instructions on how to claim their Prize. It is the responsibility of each winner to comply with the Promoter’s instructions. 
  2. The Promoter reserves the right to request each winner to provide proof of their identity and/or proof that they were responsible for the winning entry. 
  3. Each winner agrees to participate and cooperate, as required, in all publicity activities relating to the Competition, including, without limitation, being interviewed, photographed, filmed and recorded. Each winner authorises the Promoter to use such content for advertising and publicity purposes in any media in perpetuity worldwide. 
  4. It is the responsibility of each entrant to notify the Promoter of any change to their contact details. 

PART H - UNCLAIMED PRIZES 

  1. The Promoter will take all reasonable steps to identify and notify each winner in an attempt to ensure that each winner receives their Prize. However, if a winner cannot be identified or does not claim the Prize within the selected dates on which the winners are determined, their Prize is forfeited and will be awarded to the next best entry. 
  2. Each winner of an unclaimed Prize will be determined and notified in accordance with Parts F and G. 

PART I – NO LIABILITY 

  1. Any Prize supplied by a third party supplier is subject to the terms and conditions of that third party supplier. Each Prize may come with guarantees that cannot be excluded under the Australian Consumer Law. If those guarantees are not complied with, then you will have rights under the Australian Consumer Law. Subject to those guarantees and rights, the Promoter shall not be liable and excludes all liability (including negligence) for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with the Competition or the use or taking of any Prize except for any liability which cannot be excluded by law including as provided for under the Australian Consumer Law. 
  2. If entry is via Facebook/Instagram or if the Competition is promoted on Facebook, the Competition is in no way sponsored, endorsed, administered by or associated with Facebook and each entrant agrees to grant Facebook a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:  
    1. any information they provide in connection with the Competition is provided to the Promoter and not to Facebook or any other social network; and
    2. any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Facebook or any other social network. 
  3. If entry is via Instagram or if the Competition is promoted on Instagram, the Competition is in no way sponsored, endorsed, administered by or associated with Instagram and each entrant agrees to grant Instagram a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that: 
    1. any information they provide in connection with the Competition is provided to the Promoter and not to Instagram or any other social network; and 
    2. any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Instagram or any other social network. 

PART J - TERMINATION OF COMPETITION 

  1. The Promoter reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other person, subject to applicable laws.
